It's not version dependent

This also occurs on 10.5.3. The workaround Bob mentions works fine, just make yourself an alias to the "notes" executable in the Notes.app package in Applications.

You cannot, however, put the alias on your Dock, just leave it on the desktop. On my machine, running it this way starts a Terminal session that stays active till the Notes client is exited.
